By accessing banksknow.com or subscribing to any BanksKnow service, you confirm you have read and agree to these Terms of Use. BanksKnow is operated by Hedge Capital a.s., a Czech Republic research entity.

The service

BanksKnow publishes a quantitative macro index (the Elephant Index) delivered via web dashboard and API. The service outputs a position classification — 100%, 50%, or 0% — based on publicly available data inputs, identically for every subscriber. It is an impersonal data and research product, not a financial service, a personal recommendation, or investment advisory.

Not financial advice

Nothing on this website or within the service constitutes investment advice, financial advice, trading advice, or any other form of advice. The Elephant Index is provided for informational and educational purposes only. All capital allocation decisions remain the sole responsibility of the subscriber. You should consult a qualified financial adviser before making any investment decision.

No offer or solicitation

Nothing on this website constitutes a promotion, recommendation, inducement, offer, or solicitation to purchase or sell any securities, digital assets, or financial instruments. Access to or use of this website does not create any advisory, fiduciary, or contractual relationship beyond the subscription agreement.

Subscription and payment

• —Subscriptions are billed annually.
• —You may cancel at any time. Cancellation takes effect at the end of the current billing period — no partial refunds are issued.
• —Digital access begins immediately on payment. You request that immediate performance and acknowledge that any statutory withdrawal or cooling-off right — including the EU/UK 14-day right of withdrawal — is waived once delivery of the digital service has begun.
• —We reserve the right to change pricing with reasonable notice to active subscribers.
• —Access is for the named subscriber only and may not be shared or redistributed without a commercial licence.

All performance figures, backtests, and historical regime records shown on this website are hypothetical and based on applying the Elephant Index rules to historical data. They do not represent actual trading results. Past performance is not a reliable indicator of future results. Actual results will vary.

Eligibility and restricted jurisdictions

The paid subscription is not offered to, and may not be purchased by, residents of the following jurisdictions: Iran, North Korea, Syria, Cuba, Russia, Belarus, Australia, Japan, South Korea, India, China (and occupied Ukrainian territories). By subscribing you warrant that you are not resident in any listed jurisdiction. It is your responsibility to observe all applicable laws and regulations of your jurisdiction before using the service. The open-source methodology, the code repository, and the delayed public feed remain freely available worldwide — only the paid subscription is restricted.

No warranty

The service is provided on an "as is" and "as available" basis. We make no warranty as to accuracy, completeness, reliability, or fitness for any particular purpose. We are under no obligation to update or correct information and do not guarantee uninterrupted or error-free service.

Limitation of liability

To the maximum extent permitted by law, Hedge Capital a.s. and BanksKnow shall not be liable for any direct, indirect, incidental, special, or consequential loss or damage — including loss of capital — arising from use of or reliance on this website or the service.

Intellectual property

All content on this website — including the Elephant Index methodology, data outputs, copy, and design — is the property of Hedge Capital a.s. and is protected by applicable intellectual property law. Subscribers may use Index outputs for their own investment decisions. Redistribution, resale, or incorporation into commercial products requires a separate written licence.

Hedge Capital Ltd

Hedge Capital Ltd (Gibraltar) is a separately regulated fund entity that deploys the Elephant Index in managed subfunds. It is a distinct legal entity from Hedge Capital a.s. and BanksKnow. Nothing on this website constitutes an offer to invest in Hedge Capital Ltd or any of its subfunds.

Changes to these terms

We reserve the right to update these Terms at any time. Material changes will be communicated to active subscribers by email. Continued use of the service following notice constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by and construed in accordance with the laws of the Czech Republic. Any disputes shall be subject to the exclusive jurisdiction of the competent Czech courts.
